Terms of Use

These Terms of Use ("Terms") govern your access to and use of the mobile application KeyboardExtension (the "App" or "Service"), an iOS utility also referred to in-app as "ReviewReply", provided by KeyboardExtension ("Company", "we", "us", or "our"). By downloading, installing, accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

• By using the App, you represent that you have read, understand, and agree to be bound by these Terms and any policies referenced herein, including our Privacy Policy available at https://keyboardextension.forvibe.app (the "Website").
• If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
• We may refuse access to the App to anyone for any reason at any time.

2. Description of Service

• The App is an AI-powered utility designed for business owners and managers to streamline the process of responding to customer reviews across multiple platforms (e.g., Google Business, Yelp, App Store). Features include:
  • AI-generated review replies with selectable tones (apologetic, professional, grateful).
  • A custom iOS Keyboard Extension for pasting generated replies directly into review management sites.
  • A Share Extension to generate replies by sharing review text from external apps (e.g., Google Maps, Yelp).
  • History tracking of generated replies and user interactions.
• The App is offered on a freemium basis: basic features are free, while certain features (including unlimited AI generations) require a paid subscription.
• Third-party services: The App uses Apple’s StoreKit for in-app purchases and payment processing. The App may reference or facilitate interactions with third-party platforms (Google, Yelp, App Store, etc.) but is not affiliated with or endorsed by those platforms.

3. User Accounts & Registration

• Account creation: Certain features require you to create an account. You agree to provide accurate, current, and complete information when registering and to keep your account information updated.
• Account security: You are responsible for safeguarding login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
• Age restrictions: The App is not intended for children. You must be at least 13 years old to use the App. If you are under the age required by your jurisdiction to form a binding contract, you must not register for or use the App.
• Data storage: The App stores account data, history, and generated content. By creating an account you consent to our collection, storage, and use of that data as described in our Privacy Policy.

4. User Obligations & Acceptable Use

• Lawful use: You agree to use the App only for lawful purposes and in accordance with these Terms.
• Prohibited conduct includes, without limitation:
  • Using the App to create, distribute, or publish content that is unlawful, defamatory, obscene, abusive, threatening, harassing, hateful, or that violates any person’s rights.
  • Using the App to impersonate another person or entity or to misrepresent your affiliation.
  • Using the Keyboard Extension or Share Extension to harvest credentials, automate unauthorized interactions, inject malicious code, or interfere with third-party services.
  • Reverse engineering, decompiling, or attempting to extract the source code of the App.
  • Circumventing or attempting to circumvent any security or usage limits.
  • Using the App to send spam or unsolicited messages.
• Compliance: You remain solely responsible for the content you submit to the App and for ensuring that your use of generated replies complies with all applicable laws, platform rules (e.g., Google, Yelp), and contractual obligations you may have with third parties (including customers).
• Moderation: We reserve the right to remove, edit, or refuse any content that violates these Terms or that we determine, in our sole discretion, to be objectionable.

5. Intellectual Property Rights

• Ownership: The App, including its code, user interface, design, logos, trademarks, and all content provided by us (collectively, the "App Content"), is owned by KeyboardExtension or our licensors and is protected by copyright, trademark, and other intellectual property laws.
• License to you: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your compatible iOS device for your personal or internal business use.
• User content:
  • You retain ownership of text, data, and other content you submit to the App ("User Content").
  • By submitting User Content, you grant KeyboardExtension a worldwide, non-exclusive, royalty-free, transferable license to use, host, store, copy, modify, create derivative works of, communicate, publish, and display such User Content for the purpose of operating, improving and providing the Service (including generating replies and maintaining history).
• Feedback: If you provide suggestions, ideas, or feedback about the App, you grant us a perpetual, irrevocable, royalty-free license to use and exploit such feedback for any purpose without obligation to you.

6. Disclaimers & Limitation of Liability

• No professional advice: AI-generated replies are for convenience and informational purposes only. They do not constitute professional, legal, business, or any other type of advice. You are responsible for reviewing and, where appropriate, editing generated content before posting.
• No warranties: THE APP AND APP CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
• Limitation of liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL KEYBOARDEXTENSION, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE TOTAL AMOUNTS YOU PAID TO US FOR THE APP IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100) IF YOU HAVE NOT PAID US.
• Some jurisdictions do not allow certain limitations on liability; if applicable law prohibits the exclusion or limitation of certain damages, our liability will be limited to the greatest extent permitted by law.

7. Subscriptions & Payments (if applicable)

• Subscriptions: The App offers subscription-based access for certain premium features (e.g., unlimited AI generations). Subscriptions are offered on a recurring (auto-renewing) basis as described in the App.
• Billing and payment: All purchases are processed using Apple’s in-app purchase system (StoreKit) and are subject to Apple’s terms, billing, and payment policies. You authorize us to charge the payment method associated with your Apple ID.
• Auto-renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Trials and introductory offers: If you sign up for a free trial or promotional price, it will convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. Only one promotional offer may be used per account unless otherwise specified.
• Cancellations and refunds: You may cancel your subscription through your Apple ID account settings. Cancelling a subscription does not provide a refund for the current billing period. Refunds are handled by Apple in accordance with Apple’s policies.
• Changes in pricing: We may change subscription prices for the App. We will provide notice of price changes as required by applicable law and by the billing mechanism. Price changes will apply to renewals after notice.

8. Termination

• Termination by you: You may stop using the App at any time and may delete your account by following the in-app instructions or contacting us.
• Termination by us: We may suspend or terminate your access, accounts, and/or your use of the App at any time for any reason, including for violation of these Terms, with or without notice.
• Effect of termination: Upon termination or suspension, your right to use the App will cease immediately. We may delete or deactivate your account and all related content. Any provision of these Terms that, by its nature, should survive termination will survive (e.g., Ownership, Disclaimers, Limitation of Liability, Governing Law).
• Refunds upon termination: Termination by us for cause will not entitle you to a refund. Refunds for subscriptions are subject to Apple’s refund policies.

9. Governing Law

• These Terms and any disputes arising out of or relating to them will be governed by and construed under the laws of the State of California, United States, without regard to conflict of law principles.
• Disputes: Except where prohibited, you and we agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in San Francisco County, California for the resolution of any disputes.

10. Changes to Terms

• We may revise these Terms from time to time. If we make material changes, we will provide notice via the App, by email, or by posting a notice on our Website prior to the effective date of the changes.
• Continued use of the App after the effective date of the revised Terms constitutes your acceptance of the revised Terms.
